PSA-A or MPET process personal data of Truck Drivers when you visit one of our terminals, or when you interact with our applications (“e-portal”, “OptiTruck” or “Self Service Desk”) to book a pick up/drop of a container. This Privacy Notice covers the personal data we process from you in these instances.

Respectively PSA Antwerp NV (“PSA-A”, “we”, “us”) having its registered office at Napelstraat 79, 2000 Antwerp (Belgium), with company registration number 0442.652.075; or MSC PSA European Terminal NV (“MPET”, “we”, “us”) having its registered office at Napelstraat 79, 2000 Antwerp (Belgium) , with company registration number 0552.527.539; is the responsible for processing your personal data when you interact with us as a truck driver. What personal data do we process?

Following personal data can be processed name, first name, date of birth, ID card number, Alfapass number, validity safety test, gender, company, profession (function), number plate,  phone number, email address, address. We collect all or part of this data either from you directly or through other channels (Alfapass). In case you provide us personal data of others, you guarantee that this data is collected in line with the applicable legislation and the individuals have been informed accordingly.

Sensitive personal data.

When entering or exiting the terminal you will be required to provide your fingerprint to verify your identity. This process verifies whether the fingerprint provided corresponds to the fingerprint stored on the Alfapass presented. We only collect and store the result of this verification: positive or negative, no fingerprint or other biometrical data is stored or processed by us.

We will store your data for as long as this is legally required.

Why and how do we process your personal data?

We process your personal data for administrative purposes to provide you access to our terminal on your booked timeslot, to inform you about the status of the terminal, and to ensure that we fulfil our obligations under the International Ship and Port Facility Security code (ISPS), the European Regulation 275/2004 and the Belgium Shipping Code. Additionally we process your personal data for reasons safety or security (certified pick up of containers (“Certified Pick Up”) in the sense of General Port Police Regulations Port area of Antwerp).

On what ground to we process your personal data?

We process your personal data on the legal ground of performance of a contract, compliance with a legal obligation and legitimate interest, respectively article 6.1 b), c) and f) of the General Data Protection Regulation (2016/679).

Do we share your personal data with third parties?

In case this is required for the processing activities your data can be shared with other entities within the PSA group. Where we have contractual obligations your data can also be shared with our partners (security firm, NxtPort, Camco, etc.). We ensure that these recipients process your personal data in compliance with the applicable legislation.  Where recipients process your personal data outside of the European Economic Area we will conclude the necessary (contractual) safeguards in this regards (e.g. EC Standard Contractual Clauses or similar contractual safeguards) in order for your personal data to have an adequate level of protection.

If it is legally justified or required, your personal data can also be passed on to the competent authorities or other authorities involved in law enforcement (police, customs, investigation judge, … ).

How do we keep your personal data safe?

We take technical and organisational measures to ensure that your personal data is protected from unauthorized access, deletion or unlawful processing. We will make reasonable efforts to ensure that your privacy interests are protected in accordance with the applicable laws.

What are your rights in regards to your personal data?

You have the right to access your personal data and to correct it in case it is inaccurate or incomplete, have it removed or its processing restricted, to obtain a copy of your personal data, if the legal conditions for these rights have been met.
